Does Florida tax sports betting and gambling winnings?
By the W2gMatch team · Sources checked 09-06-2026 · General information, not tax advice.
No. Florida has no personal income tax. Its constitution limits any state tax on the income of natural persons to what could be credited against federal tax, and the Department of Revenue says there are no filing requirements for individuals. Winnings from Hard Rock Bet, Florida casinos or the lottery are taxed only by the federal government.
How Florida taxes the winnings
The Florida Department of Revenue states that “Florida does not impose a personal income tax, so there are no filing requirements.” [1] The constitution puts the limit in writing: no tax on the income of natural persons who are residents may be levied by the state beyond what could be credited against a similar federal or state tax. [2] In practice that means no Florida tax on any gambling win. The federal rules apply in full. [3]
Losses on the Florida return
No state return exists, so losses are a federal question only: an itemized deduction capped at winnings and, from tax year 2026, limited to 90% of losses.
What is withheld at the window
No state withholding. Federal withholding at 24% applies to payouts more than $5,000 above the wager that meet the 300-times test for sports bets, and to lottery prizes over that line; never to slot, bingo or keno wins. [3]
Residents, part-year residents and visitors
A Florida resident owes nothing to Florida on winnings from anywhere, including a trip to Las Vegas or a bet placed in another state, though that other state may tax the visitor. A visitor to Florida from a state with an income tax owes their home state on Florida winnings, and has no Florida tax to credit.
What is legal in Florida, and who sends the forms
Statewide mobile sports betting in Florida runs through Hard Rock Bet under the Seminole Tribe's compact, which gives the tribe exclusive rights; it reopened to all Floridians in December 2023 after a federal appeals court upheld the compact. [4] W-2Gs and activity statements come from Hard Rock Bet for sports bets and from each casino for slot and table play.
The federal return underneath
Federal: for tax years beginning in 2026, only 90% of gambling losses are deductible (the 90% gambling loss cap).
Every state page sits on the same federal rules: all winnings are reported on Schedule 1 whether or not a form arrives, and losses are an itemized deduction capped at winnings and, from 2026, at 90% of losses under amended section 165(d). The federal loss page and the by-state table show how Florida compares.
